6. Quotation
We will provide a quotation on selected items selected by the customer that have been chosen via our online Product selection.
We cannot guarantee all custom requests may be possible or the exact availability of certain products within a designated time scale.
The customer accepts that we will aim to provide the required product in the best possible lead time on request.
The quotation on products is valid for 21 days, the customer accepts that after this time period a revised quote may differ in cost and lead time.
7. Delivery Costs
Shall be quoted for each separate enquiry or order.
8. Price and Payment
a. The price shall be the quoted price provided by Us. The Price is exclusive of VAT.
b. We reserves the right to require payment prior to delivery by pro-forma invoice or by cash on delivery (and in respect of which time for payment shall be of the essence) unless the Customer has an account with Us whereby payment is required within 30 days of the date of which delivery is made.
c. If payment is not received within, the terms stated that We reserves the right to withdraw all credit facilities. If payment under these conditions is not made an interest charge will be made on overdue payments from the original due date until payment actually takes place at the rate of 2.5% per month.
d. All deposits are non refundable once a job has commenced.
9. Supply and Delivery
a. The property in the Goods shall not pass to the Customer until the Customer shall have paid the price plus VAT in full and no other sums whatever shall be due from the Customer to Us.
b. Until such time as the legal and beneficial ownership of the Goods passes to the Customer (and provided the Goods are still in existence and have not been resold) We shall be entitled at any time to require the Customer to deliver up the Goods to Us.
If the Customer fails to do so , the Customer hereby authorises Us to enter upon any premises of the Customer or any third party where the Goods are stored and to repossess the Goods.
c. Even before the title passes the Customer may sell and deliver the Goods to a third party but only on behalf of and to the account of Us.
Until We has been paid in full for the Goods the Customer shall be liable to account to Us for the proceeds of sale and shall keep such proceeds (including the proceeds of any insurance claim) apart from any other monies.
We shall have the right to inspect any records relating to the Customers's dealings with the Goods and the proceeds of sale.
10. Supply Risks
Once the order is confirmed and sent for delivery - the goods are then deemed to be at the Customer's risk as from delivery.
11. Force Majeure
Whilst We undertakes to do its utmost to execute every order within the specified period, We do not accept responsibility for any default due to any acts of the following exceptional circumstances:
Acts of God, war, strike, lockout, industrial action, fire, flood, drought, tempest or other event beyond the reasonable control of Us.
12. Non-Compliance with Specification
We will, at its option, replace or give credit for any products which do not comply with specification.
This is provided that the Customer gives immediate notice thereof to the Us and that We are afforded prompt and adequate opportunity to inspect delivered products before any use is made of them and compare them with the retained sample issued by Us.
13. Legal Construction
This contract is subject to the laws defined in England and Wales.
The conditions shall apply to all contracts for the sale of Goods by Us to the Customer to the exclusion of all other terms and conditions. Any variation to these Conditions shall be inapplicable unless agreed in writing by the Us.
14. Product Warranty
Unless otherwise stated, we shall provide a 12 month against faulty manufacture for products supplied to the Customer.
The warranty does not cover any damage caused by unfair wear and tear subsequent to the delivery of the products.
15. Limitation of Liability
All warranties, conditions and other terms implied by statute or common law as dictated via Section 12 of the 'Sale of Goods Act 1979' are, to the fullest extent permitted by law, excluded from the Contract.
We are not be liable to the customer for any pure economic loss, loss of profit, loss of business, depletion of goodwill or otherwise, in each case whether direct, indirect or consequential or any claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with the Contract.
16. Data Protection
We may collect and process the following data about the Customer due to the nature of purchasing of Goods or Services:
a. Information the customer gives to us which may include information from purchases made by the customer, enquiries made by the Customer, financial information disclosed by the Customer which may be used by the Us to asses levels of credit (if any), regarding the Customer. This information may dictate and decide whether or not to enter a contract with the Customer.
b. Information which is necessary to enable performance of any agreement between the Customer and Us and the exercise of any obligations under any such agreement.
c. Records of any correspondence between the Customer and Us
Any feedback by the Customer on products manufactured and/or sold by the Us which are used by the Customer. Details of transactions are kept as confidential between the Customer and Us.
